In 2026, an artist can be paid as an employee (employment contract, Article 1bis, Smart or a social office), as self-employed, through copyright income or, for occasional work, with the amateur arts allowance: at most €81.90 a day per client, 30 days a year, with no contributions or tax.

The arts work certificate

It is issued by the Arts Work Commission (Commission du travail des arts / Kunstwerkcommissie), on application through the Working in the Arts platform, if you show a professional arts practice. There are three versions:

  • Ordinary certificate (5 years): it opens up Article 1bis to you, i.e. employee status for your artistic work even without a relationship of subordination, if you and your client choose it.
  • ‘Plus’ certificate (5 years): the same rights, plus access to the rules of the arts work allowance.
  • ‘Beginner’ certificate (3 years): to get started, with more flexible conditions for access to the allowance.

The arts work allowance

It is an NEO allowance specific to arts workers with a ‘plus’ or ‘beginner’ certificate. To qualify, you need 156 working days in 24 months, calculated under the fee rule: your pay divided by €82.85 (reference daily wage on 1 January 2026), i.e. €12,924.60 gross. The entitlement lasts 3 years; to renew it, you need 78 days in 36 months.

  • The amount is a percentage of your average daily pay, between a minimum and a maximum.
  • You can earn up to €11,281.92 a year from self-employed activities, copyright income included, without any reduction in the allowance.
  • It is not affected by the time limit on unemployment benefits in force since 1 March 2026.

These 2026 amounts are taken from Amplo (secondary source): the NEO and Working in the Arts websites could not be consulted on 7 October 2026. Check them on workinginthearts.be before deciding.

The amateur arts allowance

It replaced the small allowances scheme on 1 January 2024. It covers occasional artistic work, not technical roles. Within the limits, it is exempt from tax and contributions:

  • €81.90 at most per day and per client, and €23.40 at most in travel expenses (2026 income);
  • 30 days at most per calendar year, across all clients, and 7 consecutive days at most with the same one;
  • each performance is registered in advance, by you and by the client, via Working in the Arts.

Frequently asked questions

How much can you earn with the amateur arts allowance in 2026?

€81.90 at most per day and per client, plus €23.40 of travel expenses, for at most 30 days a year: up to €2,457.00 in allowances and €702.00 in expenses, with no contributions or tax.

What is Article 1bis?

A social security rule: with an arts work certificate, your artistic work can be declared as an employee’s, even without a relationship of subordination with your client. You then pay contributions as an employee, on 108% of pay.

How do you get the arts work allowance?

With a ‘plus’ or ‘beginner’ arts work certificate, and 156 working days in 24 months, calculated under the fee rule (€12,924.60 gross in 2026). The entitlement lasts 3 years and is renewed with 78 days in 36 months.

Should you go through Smart or become self-employed?

Smart keeps you as an employee and handles invoicing, in return for 6.5% of the amount invoiced and an employment budget of 1.57 times gross pay. The self-employed person seems to keep more, but pays a minimum contribution every quarter and does not have an employee’s protection.

Is copyright income subject to social security contributions?

No, within the limits of the scheme: it is subject to withholding tax on investment income after a flat-rate expense allowance. The scheme has strict conditions (original work, actual transfer of the rights, annual ceiling).
